Ukraine and European Union member states are scheduled to commence negotiations in mid-June regarding the reforms Kyiv must undertake to meet EU benchmarks for rule of law and fundamental rights. These discussions are pivotal for Ukraine's path toward EU membership, particularly in ensuring that wartime conditions do not lead to a regression in rights protections.
The upcoming talks will focus on the “fundamentals” cluster of EU legislation and norms. Key areas include judicial independence, anti-corruption measures, democratic governance, space for civil society, media freedom, non-discrimination, and equality. Adherence to the EU Charter on Fundamental Rights and the European Convention on Human Rights will also be central to the negotiations.
While Ukraine has demonstrated progress on its accession agenda, including the adoption of roadmaps for rule of law and democratic institutions, significant concerns persist. The nation's domestic political landscape has been marked by high-level corruption scandals, pressure on anti-corruption activists, and limitations on freedom of expression and independent media outlets.
Recent legislative proposals in parliament could potentially undermine investigative journalism and facilitate Strategic Lawsuits Against Public Participation (SLAPPs). Furthermore, a proposed Civil Code risks infringing upon the rights of women, children, people with disabilities, and same-sex couples, potentially violating core European and international human rights standards. Ukrainian authorities also continue to apply broad anti-collaboration laws, leading to charges against civilians, including medical personnel, municipal workers, and teachers, for providing essential services under occupation, often under duress.
The European Union should prioritize these issues in its discussions with Ukrainian authorities, insisting on genuine and sustainable reforms while acknowledging the extraordinary challenges posed by Russia’s ongoing war. EU member states must also ensure that the accession talks are not politicized, avoiding the use of their votes on Ukraine's progress as leverage for unrelated political objectives.
Sustained commitment to human rights and democratic principles remains critical for Ukraine's future and its path toward European integration.
